This Privacy Policy (the Policy) describes how ZOZO Apparel USA, Inc. and other ZOZO Entities (ZOZO, we, us and our) collect, process, disclose, and share your personal information that we collect through our digital or online properties or services that link to this Policy (including as applicable, our website, mobile application, and social media pages) as well as our marketing activities, live activities and other activities described in this Policy (the ZOZOFIT Services). This Policy also describes your rights regarding the personal information we collect. We may provide additional or supplemental privacy policies to individuals for specific products or services that we offer at the time we collect personal information.
Before you provide us with any personal information, you should review this Privacy Policy in its entirety and understand its terms. We may update the Policy from time to time, as further described in the Changes to the Policy section below, so please check it occasionally.

We will collect the Personal Information such as the following in lawful and fair manner.

We may collect different kinds of personal information about you when you sign up for our email newsletter, purchase our products or use the ZOZOFIT App, or otherwise use the ZOZOFIT Services, which we have grouped together as follows. We may also collect other data not specifically listed here, which we will use as described in this Policy or as otherwise disclosed at the time of collection.

- Payment data, such as credit card number, expiration date, authorization number or security code

- Information provided by you through the App (such as name, postal address, email address, mobile or other telephone number, birth date, height, weight, measurement data, and gender)
- Body scan information (such as height, weight, body composition and measurements, and body composition changes) and images
- Communications data based on exchanges with you, including when you contact us through the ZOZOFIT Services, communicate with us via chat features, social media, or otherwise.
- Payment data, such as credit card number, expiration date, authorization number or security code

- Communications data based on exchanges with you, including when you contact us through the ZOZOFIT Services, communicate with us via chat features, social media, or otherwise.
- Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.
- Survey data, including information you share when you complete a survey.
(e) FEEDBACK
Types of personal information:
- Feedback whether by email, on the App, or by any other means related to the App including but not limited to its existence and purpose, any aspect of the services provided through the App.
(2) Examples of Personal Information related to your use of our Services
We, our service providers, and our business partners may also automatically collect data about you, your computer or mobile device, or your interaction with us over time, such as:
- Device data, such as your computer or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), and general location information such as city, state or geographic area.
- Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.
- Mobile app activity data, such as information about which apps you uninstall on your device, when you last accessed and used our app, and your reactions to our push notifications.
- Communication interaction data such as your interactions with our email, text or other communications (e.g., whether you open and/or forward emails) – we may do this through use of pixel tags (which are also known as clear GIFs), which may be embedded invisibly in our emails.
Some of the automatic collection described above is facilitated by the following technologies:
- Cookies, which are small text files that websites store on user devices and that allow web servers to record users’ web browsing activities and remember their submissions, preferences, and login status as they navigate a site. Cookies used on our sites include both “session cookies” that are deleted when a session ends, “persistent cookies” that remain longer, “first party” cookies that we place and “third party” cookies that our third-party business partners and service providers place.
- Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications.
- Software development kits (SDKs). An SDK is third-party computer code that we may incorporate into our app that may be used for a variety of purposes, including to provide us with analytics regarding the use of our app, to integrate with social media, or add features or functionality to our app. SDKs may enable third parties to collect information directly via our app.

Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.
(3) Examples of Personal Information collected from third parties
We may combine personal information we receive from you with personal information that we obtain from other sources, such as:
- Partners, such as co-sponsorship opportunities
- Third-party services, such as social media services, that you use to log into, or otherwise link to, your Service account. This data may include your username, profile picture and other information associated with your account on that third-party service that is made available to us based on your account settings on that service.
Children’s Privacy: If a minor under 16 submits personal information to us and we learn that the personal information is the information of a minor under 16, we will attempt to delete the information as soon as possible. If you believe that we might have any personal information from a minor under 16, please contact us at support@zozofit.com (Customer Service Division).
2. HOW WE USE YOUR PERSONAL INFORMATION
We may use your personal information for the following purposes or as otherwise described at the time of collection. For example, we use personal data for the following purposes:
Provision and maintenance of our services.

In some cases, we may use your personal information for further uses, in which case we will ask for your consent to use of your personal information for those further purposes if they are not compatible with the initial purpose for which information was collected.
3. HOW WE DISCLOSE YOUR PERSONAL INFORMATION
(1) We may share your personal information with the following parties and as otherwise described in this Privacy Policy or at the time of collection.
- Other ZOZO Entities. ZOZO, Inc. and its affiliates (excluding ZOZO Apparel USA, Inc.).
- Service providers. Third parties that provide services on our behalf or help us operate the Service or our business (such as hosting, information technology, customer support, email delivery, marketing, consumer research and website and app analytics, such as Braze).
- Payment processors. Any payment card information you use to make a purchase on the Service is collected and processed directly by our payment processors, such as Shopify Payments. Shopify may use your payment data in accordance with its privacy policy, https://www.shopify.com/legal/privacy.
- Advertising partners. Third-party advertising companies for the interest-based advertising purposes described above.
- Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.
- Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the Compliance and protection purposes described above.

Business transferees. We may disclose personal information in the context of actual or prospective business transactions (e.g., investments in us, financing of us, public stock offerings, or the sale, transfer or merger of all or part of our business, assets or shares), for example, we may need to share certain personal information with prospective counterparties and their advisers. We may also disclose your personal information to an acquirer, successor, or assignee of us as part of any merger, acquisition, sale of assets, or similar transaction, and/or in the event of an insolvency, bankruptcy, or receivership in which personal information is transferred to one or more third parties as one of our business assets.
(2) OTHER SITES AND SERVICES
The ZOZOFIT Service may contain links to websites, mobile applications, and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their privacy policies, privacy and security practices, and actions. We encourage you to read the privacy policies of the other websites, mobile applications and online services you use.
(3) INTERNATIONAL DATA TRANSFERS
Your personal information may be transferred outside of your home jurisdiction, including countries whose laws may not offer the same level of protection for personal data as are enjoyed within your home jurisdiction. In particular, we may disclose your personal data within other ZOZO Entities outside of your home jurisdiction, including entities located in Japan.
4. HOW WE RETAIN YOUR PERSONAL INFORMATION
We generally only retain your personal information as long as is necessary to fulfill the purposes for which we collected it. To determine the appropriate retention period for personal information, we may consider factors such as the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.
When we no longer require the personal information we have collected about you, we may either delete it, anonymize it, or isolate it from further processing.
5. HOW WE PROTECT YOUR PERSONAL INFORMATION
We employ technical, administrative, and physical safeguards designed to protect the personal information we collect from accidental or unauthorized destruction, loss, alteration, disclosure, or access.
No transmission or storage system can be guaranteed to be completely secure, and transmission of information via the Internet is not completely secure. We cannot guarantee the security of your personal information.
6. YOUR CHOICES
(1) Ability to access, update and correct personal information.
To make changes to your personal information, please contact us at support@zozofit.com (Customer Service Division).
(2) Withdraw consent
You may be entitled under applicable law to withdraw your consent, subject to legal or contractual restrictions.
(3) Opt-out of communications.
You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us. Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails.
If you receive text messages from us, you may opt out of receiving further text messages from us by replying STOP to our message.
You may also turn off push notifications from us by adjusting your preferences in the iOS notification settings.
(4) Advertising choices.
You may be able to limit use of your information for interest-based advertising through the following settings/options/tools:
- Browser settings. Changing your internet web browser settings to block third-party cookies.
- Privacy browsers/plug-ins. Using privacy browsers and/or ad-blocking browser plug-ins that let you block tracking technologies.
- Platform settings. Certain platforms offer opt-out features that let you opt-out of use of your information for interest-based advertising. For example, you may be able to exercise that option for Google and Facebook, respectively, at the following websites:

- Ad industry tools. Opting out of interest-based ads from companies that participate in the following industry opt-out programs:

- AppChoices mobile app, available at https://www.youradchoices.com/appchoices, which will allow you to opt-out of interest-based ads in mobile apps served by participating members of the Digital Advertising Alliance.
- Mobile settings. Using your mobile device settings to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.
You will need to apply these opt-out settings on each device and browser from which you wish to limit the use of your information for interest-based advertising purposes.
(5) Linked third-party platforms.
If you choose to connect to the Service through your social media account or other third-party platform, you may be able to use your settings in your account with that platform to limit the information we receive from it. If you revoke our ability to access information from a third-party platform, that choice will not apply to information that we have already received from that third party.
7. CHANGES TO THIS PRIVACY NOTICE
ZOZO may modify or update this Policy from time to time. We encourage you to revisit this page often to remain fully informed of our Policy or you can contact us at any time to obtain the latest copy of this Policy.
Please ensure that you regularly check this Policy so you are fully aware of any changes or updates. The “Last Updated” legend above indicates when this Policy was last changed. Continued use of ZOZO applications and devices following notice of such changes shall indicate your acknowledgment of such changes and agreement to be bound by the terms and conditions of such changes.

9. STATE LAW PRIVACY RIGHTS
Except as otherwise provided, this section applies to residents of California, Virginia and other states to the extent they have privacy laws applicable to us that grant their residents the rights described below (collectively the “State Privacy Laws”).
This section describes how we collect, use, and share Personal Information of residents of these states and the rights these users may have with respect to their Personal Information. Please note that not all rights listed below may be afforded to all users and that if you are not a resident of one of these states listed above, you may not be able to exercise these rights. In addition, we may not be able to process your request if you do not provide us with sufficient detail to allow us to confirm your identity or to understand and respond to your request.
For purposes of this section, the term “Personal Information” has the meaning given to “personal data”, “personal information”, or other similar terms and “Sensitive Personal Information” has the meaning given to “sensitive personal information,” “sensitive data”, or other similar terms in the State Privacy Laws, except that in neither case does such term include information exempted from the scope of the State Privacy Laws. In some cases, we may provide a different privacy notice to certain categories of residents of these states, such as job applicants, in which case that notice will apply instead of this section.
The categories of sources from which we collect personal information and our business and commercial purposes for using and disclosing personal information are set forth above in “PERSONAL INFORMATION WE COLLECT” “HOW WE USE YOUR PERSONAL INFORMATION”, and “HOW WE DISCLOSE YOUR PERSONAL INFORMATION”, respectively.
We will retain personal information in accordance with the time periods set forth above in “HOW WE RETAIN YOUR PERSONAL INFORMATION”.
(1) Categories of Personal information collected.
The personal information that we may collect, or may have collected from you in the preceding twelve months, fall into the following categories established by the California Privacy Rights Act and other state privacy laws, depending on how you engage with our Offerings:
- identifiers such as your name, alias, address, phone numbers, IP address, email address, account name;
- personal information as described in subdivision (e) of Section 1798.80 of the California Civil Code, such as a credit card number or other payment information;
- characteristics of protected classifications under California or US federal law, such as age or gender;
- commercial information, such as purchase activity;
- internet or other electronic network activity information, including online activity data, mobile app activity data, communication interaction data;
- audio, visual, electronic or other similar information, including when you communicate with us by phone or otherwise;
- inference data, such as information about your purchase preferences; and
- personal information collected and analyzed concerning a consumer’s health such as body scan information and images.
(2) Personal information that we collect, use and disclose.
We have summarized the Personal Information we collect and may disclose to third parties by reference below to both the categories defined in the “Personal information we collect” section of this Policy above and the categories of Personal Information specified in the CCPA (Cal. Civ. Code §1798.140) and describes our practices currently and during the 12 months preceding the effective date of this Privacy Policy. Information you voluntarily provide to us, such as in free-form webforms, may contain other categories of personal information not described below.

(3) Your privacy rights.
The State Privacy Laws may provide residents with some or all of the rights listed below. However, these rights are not absolute and some State Privacy Laws do not provide these rights to their residents. Therefore, we may decline your request in certain cases as permitted by law.
- Information. You can request the following information about how we have collected and used your Personal Information during the past 12 months:
- The categories of Personal Information that we have collected.
- The categories of sources from which we collected Personal Information.
- The business or commercial purpose for collecting and/or selling Personal Information.
- The categories of third parties with which we share Personal Information.
- The categories of Personal Information that we sold or disclosed for a business purpose.
- The categories of third parties to whom the Personal Information was sold or disclosed for a business purpose.
- Access. You can request a copy of the Personal Information that we have collected about you.
- Appeal. You can appeal our denial of any request validly submitted.
- Correction. You can ask us to correct inaccurate Personal Information that we have collected about you.
- Deletion. You can ask us to delete the Personal Information that we have collected from you.
- Opt-out.
- Opt-out of certain processing for targeted advertising purposes. You can opt-out of certain processing of personal information for targeted advertising purposes.
- Opt-out of profiling/automated decision making. You can opt-out of automated processing or profiling performed on personal information to evaluate, analyze, or predict personal aspects related to a person's economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.
- Opt-out of other sales of personal data. You can opt-out of other sales of your Personal Information.
- Consumers under 16. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.
- Sensitive Personal Information. We do not process Sensitive Personal Information for the purpose of inferring characteristics about consumers under the California Consumer Privacy Act.
- Nondiscrimination. You are entitled to exercise the rights described above free from discrimination as prohibited by the State Privacy Laws.
(4) Procedure for request to exercise your right
- Exercising your right to information/know, access, appeal, correction, and deletion. You may submit requests to exercise your right to information/know, access, appeal, correction, or deletion by calling us at (833) ZOZOFIT (833-969-6348) or by emailing us at support@zozofit.com (Customer Service Division).
Exercising your right to opt-out of the “sale” or “sharing” of your Personal Information. While we do not sell personal information for money, like many companies, we use services that help deliver interest-based ads to you as described above. The State Privacy Laws may classify our use of some of these services as “selling” or “sharing” your Personal Information with the advertising partners that provide the services. You can by submit requests to opt-out of tracking for targeted advertising purposes or other sales of Personal Information here: https://help.zozofit.com, via email to support@zozofit.com or via phone by calling (833) ZOZOFIT (833-969-6348), or by broadcasting the global privacy control signal.
- Verification of Identity. We may need to verify your identity in order to process your information/know, access, appeal, correction, or deletion requests and reserve the right to confirm your residency. To verify your identity, we may require government identification, a declaration under penalty of perjury, or other information, where permitted by law.
- Authorized agents. Under some State Privacy Laws, you may enable an authorized agent to make a request on your behalf. However, we may need to verify your authorized agent’s identity and authority to act on your behalf. We may require a copy of a valid power of attorney given to your authorized agent pursuant to applicable law. If you have not provided your agent with such a power of attorney, we may ask you to take additional steps permitted by law to verify that your request is authorized, such as by providing your agent with written and signed permission to exercise your State Privacy Laws rights on your behalf, the information we request to verify your identity, and confirmation that you have given the authorized agent permission to submit the request.
- Other California Privacy Rights. California residents have the right to receive information that identifies any third party companies or individuals that ZOZO has disclosed or shared your Personal Information within the previous calendar year, as well as a description of the categories of Personal Information, disclosed to that third party. You may obtain this information once a year and free of charge by contacting us at the address below.
